Release of Liability, Waiver, Assumption of Risks, and Arbitration Agreement

PLEASE READ THIS NOTICE. IT CONSTITUTES PART OF YOUR CONTRACT FOR TRAVEL-RELATED SERVICES. PLEASE CHECK YOUR DOCUMENTS WHEN YOU RECEIVE THEM. CALL Go N' Wander LLC IF YOU HAVE ANY QUESTIONS. MOST DISCOUNT FARES INVOLVE RESTRICTIONS. CHANGING CARRIERS OR FLIGHTS COULD RESULT IN THE AIRLINE DEMANDING AN INCREASED FARE.

Go N' Wander LLC is acting as your travel agent

Go N' Wander LLC ("Go N' Wander LLC") is acting as a mere agent for SUPPLIERS in selling travel-related services, or in accepting reservations or bookings for services that are not directly supplied by us (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.).

Go N' Wander LLC shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury, or death to travelers or travelers' companions or group members.

Client/traveler is responsible for their own personal conduct and behavior at all times during the period of travel, including alcoholic consumption. Agency shall bear no responsibility for any actions in regard thereto.

Unless the term "guaranteed" is specifically stated in writing on your tickets, invoice, or reservation itinerary, Go N' Wander LLC does not guarantee any of such supplier's rates, bookings, reservations, connections, scheduling, or handling of baggage or other personal effects.

Your responsibilities and assumed risks

Traveler assumes complete and full responsibility for, and hereby releases Go N' Wander LLC from, any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety and security conditions of such destinations.

We specifically recommend that U.S. Citizens traveling internationally (including travel to Bermuda) do so with a valid U.S. Passport. For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department at (202) 647-5335 or visit travel.state.gov.

Go N' Wander LLC shall not be responsible for any injuries, losses or damages in connection with terrorist activities, social or labor unrest, mechanical or structural integrity of air, sea, and ground transportation and accommodations, diseases, viruses, local laws, terrorist acts, climatic conditions, Acts of God, delays, changes or cancellation of travel due to weather conditions, hotel services, accidents or health related problems before or while in-transit, during, and after a tour, or any other actions, omissions, or conditions outside of Go N' Wander LLC's control.

No refund(s) will be issued for cancellations due to actual or threatened terrorist events. There will be no refunds due to fear of travel from actual or threatened terrorist, health, political or other similar events.

Travel Insurance

It is the traveler's responsibility to protect their purchases and Travel Insurance is strongly recommended. Traveler is advised to obtain appropriate insurance coverage against these risks (medical, disability, trip cancellation, lost baggage). We partner with multiple travel insurance providers · after you book, Merceades will send you a personalized quote so you can pick the right coverage for your trip.

Chargebacks

Traveler understands that should Traveler initiate any chargeback with Traveler's credit card company to avoid previously agreed upon fees, Go N' Wander LLC will utilize all rights and remedies under the laws of the State of Connecticut to uphold previously agreed contractual provisions. The cancellation fees do not cease to exist in the event of a chargeback. Go N' Wander LLC will be prompted to pursue litigation and incur attorneys' fees and costs which will be included in addition to all cancellation fees.

Alternative Dispute Resolution

Go N' Wander LLC desires to maintain friendly relationships with its clients. We have established an alternative mediation program in the event of a misunderstanding or dispute:

If a dispute arises out of or relates to this contract, or breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation administered by the World Travel Dispute Center under the applicable guidelines as established by the International Forum for Travel and Tourism (IFTTA) before resorting to arbitration, litigation, or some other dispute resolution procedure.

If mediation is not successful, the parties will settle by binding arbitration administered by the World Travel Dispute Center under the applicable IFTTA guidelines. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. If litigation is necessary to enforce this agreement, the prevailing party(s) shall receive costs and attorney's fees.

Eligibility

The Services offered by Go N' Wander LLC are available for purchase by residents of the United States while in the United States, its territories, possessions, and protectorates, who have all the requisite power and authority to enter into and perform the obligations under these Terms and Conditions. Travelers must be over the age of 18 to purchase a Go N' Wander LLC Trip.

Modification of Our Terms and Conditions

Our Terms and Conditions may be amended or modified by us at any time, without notice, on the understanding that such changes will not apply to Trips booked prior to the amendment or modification. It is therefore essential that you consult and accept our Terms and Conditions at the time of making a booking.

Payments

I understand if I have an unpaid balance to Go N' Wander LLC and do not make satisfactory payment arrangements, my account may be placed with an external collection agency. I will be responsible for reimbursement of any fees from the collection agency, including all costs and expenses incurred collecting my account, and possibly including reasonable attorney's fees.

I agree that Go N' Wander LLC and any designated external collection agency are authorized to (i) contact me by telephone at the telephone number(s) I am providing, including wireless telephone numbers, which could result in charges to me, (ii) contact me by sending text messages (message and data rates may apply) or emails, and (iii) use pre-recorded/artificial voice message and/or automatic dialing devices.

Accepted payment methods

• International credit cards including American Express, Visa, MasterCard, and Discover
• Wire transfers (by request)

Prices

Our prices are contractual tariffs. No claim relating to the price of a Trip will be considered once the reservation is effective. Unless otherwise stated in the description of the offer, the following will NOT be included as part of the advertised price:

• Items of a personal nature such as incidentals and laundry
• Excess baggage charges
• Port charges (where applicable)
• Foreign government departure taxes
• Costs of Passports or Visas
• Inspection, customs, immigration, or naturalization fees
• Service fees
• Single room supplement
• Travel insurance (health, accidents, lost baggage, trip cancellation)
• Airport parking
• Tips and gratuities (see Latin Takeover Addendum below)
• Any other activities or items not explicitly advertised as included

We endeavor to secure the lowest possible fares, but we cannot guarantee that the price of your travel will be the lowest possible rate obtainable.

Cancellations and Alterations Policies

We can accept refund requests only if the following conditions have been met:

1. If, and only to the extent that, the Suppliers provide for and allow cancellations and refunds
2. It is not a "no show" situation (most "no show" bookings are ineligible for any waiver)
3. We are able to receive waivers from Suppliers to process the requested cancellation and refund

Refunds may take up to 4-6 business weeks to process. The cancellation of your booking for whatever reason does not exempt you from paying all the sums that you owe to Go N' Wander LLC.

Name Transfers

Name transfers are allowed at no fee before the final payment deadline. After that, name transfers may incur additional fees per supplier rules. Email reservations@gonwander.com with the new guest's information.

Issuing Travel Documents

We have an eco-friendly philosophy and our general practice is to send documents to our customers electronically whenever possible. We reserve the right to charge an administration fee should you make a request for documents to be sent as a hard copy.

If a Traveler provides incorrect information, Go N' Wander LLC does not assume any liability if the Trip is adversely affected or made impossible by the non-receipt of travel documents.

Insurance

Go N' Wander LLC strongly recommends that all Travelers purchase travel, cancellation, lost baggage, and/or medical emergency insurance for the cruise. While we partner with multiple travel insurance providers and will send you a personalized quote, you acknowledge that it is your responsibility to understand the limitations of your coverage and purchase additional insurance as needed. Go N' Wander LLC is not responsible for any uninsured losses.

Passports, Visas, Health Requirements, and Travel Risks

It is the Traveler's responsibility to verify they have all the necessary visas, passports, and vaccinations prior to travel. A full and valid passport is required for international travel including travel to Bermuda. Your passport must be valid for at least six (6) months beyond the scheduled end of your itinerary.

You must obtain and have possession of a valid passport, all visas, permits, certificates, and vaccination certificates required for your entire Trip. Go N' Wander LLC assumes no responsibility for travelers who may be denied boarding or entry due to failure to obtain required documentation or vaccinations.

We cannot accept responsibility if you are refused passage on any cruise, airline, transport or entry into any country due to failure on your part to carry or obtain the correct documentation including required vaccinations. If failure results in fines, surcharges, claims, or other financial penalties imposed on us, you will be responsible for indemnifying and reimbursing us accordingly.

Accommodations

Go N' Wander LLC provides accommodations for its Trips through third-party Vendors (Norwegian Cruise Line, in the case of the Latin Takeover) and retains no ownership or management interest in those Accommodations. We do not guarantee the location or amenities of the Accommodations nor the performance of the third-party Vendors. If any issues arise, please contact the owner/operators of the respective Accommodations directly.

Prices of Accommodations on the Latin Takeover are based on double occupancy (two guests per cabin). Single, triple, and quad occupancy cabins are not available for this sailing.

Any notices required or permitted hereunder shall be given via email to reservations@gonwander.com or by phone at (203) 212-9730.

Seller of Travel Disclosures

Go N' Wander LLC is a registered travel seller as required by law in certain states. Any payments made to Go N' Wander LLC are held in a business account and remitted directly to the travel suppliers on your behalf. Go N' Wander LLC does not provide escrow services or operate as a bonded seller unless required by law.

California Residents

Go N' Wander LLC is not currently a participant in the California Travel Consumer Restitution Fund. California law requires sellers of travel to register with the Attorney General's office. Registration as a seller of travel does not constitute approval by the State of California.

Hawaii Residents

Go N' Wander LLC is not a participant in the Travel Agency Recovery Fund administered by the Department of Commerce and Consumer Affairs.

Limitation of Liability

Go N' Wander LLC is acting as a mere agent for suppliers and shall not be responsible for personal injury or property damage, loss or delay, or change of itinerary incurred by any person or tour participant arising out of the act or negligence of any direct or supplemental air carrier or other person or entity engaged in transporting the passenger, hotel or other person rendering any services or accommodations being offered in these tours.

Go N' Wander LLC shall not be responsible for any injuries, death, damages, loss, or delay in any means of transportation or by reason of any event beyond our actual control or of any agent or supplier or due to force majeure.

We reserve the right to substitute hotels or accommodations of similar category (if available) or change schedules without prior notice should circumstances so demand.

Indemnification and Release

By agreeing to book the trip with Go N' Wander LLC, I acknowledge that I have carefully read the above paragraphs, including the information regarding cancellations and refunds. I DO HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD Go N' Wander LLC and its agents, employees, officers, directors, associates, suppliers, affiliated companies, and subcontractors HARMLESS against any and all liability, actions, causes of action, debts, suits, claims, and demands of any kind which I now have or which may hereafter arise out of or in connection with my trip.

THE TERMS OF THIS AGREEMENT SHALL SERVE AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK for myself, my heirs, assignees, administrators, executors, and all members of my family, including any minors accompanying me.

Disputes: Governing Law, Jurisdiction

All parties hereby consent to the jurisdiction of all state and federal courts sitting in the State of Connecticut, and agree that venue for any such action shall lie exclusively in such courts without regard to choice of law principles. Such courts shall be the exclusive forum for any legal actions brought in connection with this Agreement or the relationships among the parties hereto.
